The Beef Farm Software End User License
Pick-up, Shipment, and Risk of Loss during Shipment
All items purchased from The Beef Farm are made with the understanding that customers are responsible for pick-up of the purchased product during a designated time as chosen by The Beef Farm. Customers are solely responsible for providing their own adequate storage containers to ensure frozen foods remain frozen during transportation from the designated pickup location to final destination. In the event rare shipping arrangements are agreed to, shipping will be made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
Food Safety
Due to the perishable nature of our product, The Beef Farm shall not be held responsible for product quality or premature soilage due to improper food handling methods by consumers. Food safety and the prevention of foodborne illnesses cannot be controlled by The Beef Farm once consumers receive our product. We highly encourage consumers to educate themselves on proper storage and transportation of temperature sensitive perishables as outlined by the United States Department of Agriculture (USDA) prior to their scheduled pick-up date. Product Descriptions, Pricing, Non-Refundable Deposits, and Payments
The Beef Farm attempts to be as accurate as possible. However, The Beef Farm does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.
With respect to bulk items sold by The Beef Farm, we cannot confirm the exact total pounds of a particular order until your order is received after harvest. Although we make every effort to ensure order uniformity can take place, fluctuations may still occur due to the natural variation in animals.
Bulk pricing is based on average weights and costs that are applied to the appropriate product portion selected by the customer. Individual meat cuts are priced per pound based on average production and storage costs, as well as the overall yield of the individual harvested beef.
The Beef Farm accepts legal tender as defined by Section 31 U.S.C. 5103 and outlined by the United States Department of the Treasury. All electronic payments will be collected at the time of order placement. If a transactional error occurs during collection of payment, we will do one of the following: refund the overpayment balance between the amount collected and the product price OR provide the option to increase the size of the order matching the payment amount. If the collected amount is lower than the selected product price (which includes order deposits), the remaining balance will be due no later than 45 days PRIOR to the scheduled pickup date.
In the event balance of payment is not received 45 days prior to the scheduled pickup date, The Beef Farm reserves the right to cancel the order and notify you of such cancelation as a remedy of payment failure without refund of deposit. Order deposits are non-transferable and must be made in good faith of future order acceptance.
Non-Refundable Deposit
Buyers shall pay a non-refundable deposit to The Beef Farm in the amount of 15% of the total purchase price within_____ (3 days if not filled in) days of mutual acceptance of these Terms and Conditions. If order fulfillment fails to take place for any reason other than default by The Beef Farm, the nonrefundable deposit shall remain the property of The Beef Farm.
Sweepstakes and Giveaways
Occasionally The Beef Farm give away free prizes. Specific entry information will be provided with each sweepstake or giveaway in addition to end date/times and terms of prize redemption. NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
By participating in the sweepstakes or giveaways, each Entrant unconditionally accepts and agrees to comply with and abide by the Official Rules and the decisions of The Beef Farm, which shall be final and binding in all respects. The Beef Farm is responsible for the collection, submission or processing of entries and the overall administration of the sweepstakes or giveaway. Entrants should look solely to The Beef Farm with any questions, comments or problems related to the sweepstakes or giveaway by contacting us by email during the promotion period.
Only one prize per person and per household will be awarded. Gift cards and gift certificates are subject to the terms and conditions of the issuer and are valid for one year after date of issue. Prizes cannot be transferred, redeemed for cash or substituted by winner. The Beef Farm reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize is unavailable or cannot be awarded, in whole or in part, for any reason. The approximate retail value (ARV) of the prize represents our good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. The Beef Farm makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. The Beef Farm will not replace any lost or stolen prize items.
Sweepstakes and giveaways are open to legal residents of Alabama and will only be awarded to registered participants located in said locations. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner. Failure to comply with the Official Rules will result in forfeiture of the prize. Prize winners are solely responsible for prize redemption at the location chosen by The Beef Farm.

Disputes
Any dispute relating in any way to your visit to The Beef Farm or to products you purchase through The Beef Farm shall be submitted to confidential arbitration in Huntsville, AL except that, to the extent you have in any manner violated or threatened to violate The Beef Farm' intellectual property rights, The Beef Farm may seek injunctive or other appropriate relief in any state or federal court in the state of Alabama, and you consent to exclusive jurisdiction and venue in such courts. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
